Terms of Service

These Terms of Service ("Terms", "Agreement") constitute a legally binding agreement between you ("User", "you", "your") and CraftersQ Inc. ("CraftersQ", "we", "us", "our"), operating the platform at craftersq.com. By creating an account, accessing, or using any part of our platform, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.
IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE PLATFORM. Continued use after changes constitutes acceptance.
1. Definitions
- "Platform" — The CraftersQ website builder, AI generation tools, hosting services, APIs, dashboards, and all related services available at craftersq.com and its subdomains.
- "User Content" — Any content, data, text, images, videos, designs, code, or materials you upload, create, generate, or publish through the Platform.
- "Generated Content" — Websites, pages, images, text, or code created using our AI tools on your behalf.
- "End Customer" — Any visitor or customer who interacts with a website built on the Platform.
- "Subscription" — Your paid or free plan and its associated features, limits, and billing cycle.
- "Transaction Fee" — The percentage-based platform fee CraftersQ charges on each payment transaction processed through sites built on the Platform.
2. Eligibility & Account Registration
2.1 Eligibility
You must be at least 18 years of age (or the age of majority in your jurisdiction) and have the legal capacity to enter into contracts. If you are using the Platform on behalf of a business entity, you represent that you have authority to bind that entity.
2.2 Account Security
You are solely responsible for maintaining the confidentiality of your account credentials. You agree to immediately notify us of any unauthorized access. We are not liable for any loss arising from your failure to secure your account.
2.3 Accurate Information
You agree to provide truthful, accurate, and complete information during registration and to keep it updated. We reserve the right to suspend accounts with inaccurate information.
3. Platform Services
3.1 Website Building & Hosting
CraftersQ provides tools to create, customize, and host websites. We provide managed hosting on shared infrastructure. We do not guarantee 100% uptime and are not liable for downtime, data loss, or service interruptions beyond our reasonable control.
3.2 AI-Generated Content
Our AI tools generate content based on your inputs. AI-generated content may not be unique, may contain errors or inaccuracies, and may be similar to content generated for other users. You are solely responsible for reviewing, editing, and verifying all generated content before publishing. CraftersQ makes no representations regarding the accuracy, originality, or fitness of AI-generated content.
3.3 Third-Party Integrations
The Platform integrates with third-party services (Stripe, Google, etc.). Your use of those services is governed by their respective terms. We are not responsible for third-party service failures, changes, or discontinuation.
4. Subscriptions, Billing & Fees
4.1 Plans & Pricing
We offer Free, Light, Core, Business, and Enterprise plans with varying features and limits. Pricing is subject to change with 30 days' notice for existing subscribers. New pricing takes effect immediately for new subscriptions.
4.2 Billing & Renewal
Paid subscriptions are billed upfront for the entire term (monthly, 1-year, 2-year, or 3-year). Subscriptions auto-renew at the end of each billing period at the then-current rate unless cancelled before renewal.
4.3 Transaction Fees
Sites that accept payments through the Platform are subject to a CraftersQ transaction fee on each successful payment. The fee percentage varies by plan and billing period:
- Free: 3.5% per transaction
- Light: 3.0% (monthly) → 1.5% (3-year)
- Core: 2.5% (monthly) → 1.0% (3-year)
- Business: 2.0% (monthly) → 0.5% (3-year)
- Enterprise: 1.5% (monthly) → 0% (3-year)
Transaction fees are in addition to any third-party payment processor fees (e.g., Stripe). Transaction fees are non-refundable once collected.
4.4 Transaction Volume Limits
Each plan has a monthly transaction volume limit. Exceeding your limit incurs an overage fee of +1% on transactions above the cap. Repeated overages may require a plan upgrade.
4.5 Refunds & Cancellations
Subscriptions may be cancelled at any time. No pro-rata refunds are provided for unused time on a plain cancellation. Upon cancellation, your plan remains active until the end of the current billing period. After expiration, your site will be unpublished and data retained for 30 days before deletion.
When you upgrade to a higher plan, the new plan is charged in full and your previous plan is cancelled immediately. The unused prepaid portion of your previous plan (including the corresponding tax) is calculated on a pro-rata, time-based basis and refunded to your original payment method.
4.6 Failed Payments, Retries & Suspension
If a subscription payment is declined, we will notify you by email at the address on your account and re-attempt the payment automatically approximately every 24 hours, for up to 7 attempts. Each notification will state the amount outstanding, the reason for the decline, the number of attempts remaining, and the date of the next attempt.
A late payment fee of C$5.00 applies to each failed payment attempt, to a maximum of 7 such fees per unpaid invoice. These fees are itemised on your next invoice and cease to accrue as soon as the outstanding balance is paid. Where an unpaid invoice is settled in full before the retry cycle completes, no further fees are charged. We may waive these fees at our discretion.
If the outstanding balance remains unpaid after the final attempt, your published website or websites will be suspended and will display a temporary notice to visitors instead of your content. During suspension, order processing, checkout, and contact form delivery on your website will be disabled.
Suspension is temporary and non-destructive. Your website content, products, orders, messages, and account data are retained in full and are not deleted or altered. You may restore service at any time by paying the outstanding balance from your CraftersQ dashboard; restoration is automatic and immediate upon successful payment, and no reactivation fee is charged. Your subscription is not cancelled by suspension.
If an account remains suspended for non-payment for more than 30 consecutive days, we may cancel your subscription and unpublish your websites in accordance with section 11. If you are unable to pay, contact us before the retry cycle completes and we will make reasonable efforts to agree alternative arrangements.
5. Acceptable Use Policy
5.1 Prohibited Content
You may NOT use the Platform to create, host, or distribute:
- Content that is illegal, fraudulent, deceptive, or promotes illegal activities
- Malware, phishing pages, scam websites, or any content designed to steal data
- Content that infringes copyrights, trademarks, patents, or other intellectual property rights
- Hate speech, harassment, threats, doxxing, or content promoting violence
- Child sexual abuse material (CSAM) or exploitation of minors in any form
- Non-consensual intimate imagery or revenge porn
- Spam, bulk unsolicited communications, or deceptive marketing
- Content promoting regulated substances without proper licensing
- Gambling without appropriate jurisdiction licenses
- Impersonation of individuals, companies, or government entities
5.2 Prohibited Activities
- Attempting to gain unauthorized access to the Platform, other accounts, or our infrastructure
- Reverse engineering, decompiling, or disassembling any part of the Platform
- Using automated tools to scrape, crawl, or extract data from the Platform beyond authorized API use
- Launching denial-of-service attacks or intentionally overloading our systems
- Reselling Platform access or creating derivative services without written authorization
- Circumventing usage limits, transaction fee collection, or security measures
- Using the Platform to compete directly with CraftersQ without written consent
5.3 Enforcement
We reserve the right to remove content, suspend, or terminate accounts that violate this policy without notice and without refund. We may report illegal activities to law enforcement.
6. Intellectual Property
6.1 Your Content
You retain ownership of User Content you upload. By using the Platform, you grant CraftersQ a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute your content solely for the purpose of operating the Platform and providing services to you.
6.2 AI-Generated Content
You own the output generated by our AI tools based on your prompts and inputs, subject to: (a) the underlying AI model provider's terms, (b) the limitation that similar outputs may be generated for other users, and (c) your responsibility to ensure the output does not infringe third-party rights.
6.3 Platform IP
CraftersQ retains all rights to the Platform itself, including its code, design, AI models, templates, branding, documentation, and proprietary technology. Nothing in these Terms transfers ownership of Platform IP to you.
6.4 Templates & Designs
Templates provided by CraftersQ are licensed for use within the Platform only. You may not extract, resell, or redistribute templates outside of websites you build on CraftersQ.
7. Data, Privacy & Security
7.1 Data Processing
We process personal data as described in our Privacy Policy. By using the Platform, you consent to data processing as described therein.
7.2 Your Responsibility for End Customer Data
If your website collects personal data from End Customers (forms, payments, accounts), YOU are the data controller. You are solely responsible for: (a) providing appropriate privacy notices to your users, (b) obtaining necessary consents, (c) complying with GDPR, CCPA, PIPEDA, and other applicable privacy laws, and (d) handling data subject requests.
7.3 Data Retention & Deletion
Upon account deletion, we will delete your data within 30 days, except where retention is required by law or for legitimate business purposes (e.g., billing records retained for 7 years).
7.4 Security
We implement commercially reasonable security measures. However, no system is impenetrable. We do not guarantee that your data will never be accessed, disclosed, or destroyed by breach of our safeguards.
8. Payment Processing (Stripe Connect)
8.1 Connected Accounts
To accept payments on your website, you must connect a Stripe account through our Stripe Connect integration. You agree to Stripe's Connected Account Agreement and Terms of Service.
8.2 Platform Fee Collection
By connecting your Stripe account, you authorize CraftersQ to collect the applicable platform transaction fee (as specified in Section 4.3) as an application fee on each transaction. This fee is deducted automatically before funds reach your account.
8.3 Disputes, Chargebacks & Refunds
You are responsible for all disputes, chargebacks, and refunds arising from your transactions, including the underlying transaction amount and any processing, chargeback, or dispute fees charged by the payment processor. CraftersQ does not supply the goods or services you sell and makes no representations to your End Customers about them.
Payments on your website may be processed on CraftersQ's payment processor account with your business named on the customer's statement. Where this is the case, the processor debits CraftersQ for refunds and chargebacks in the first instance. You therefore authorize CraftersQ, without further notice, to recover any such amount from you by any of the following means, in any order:
- Reversing all or part of a transfer previously made to your connected account, including where this results in a negative balance that the processor recovers from your future sales;
- Withholding or offsetting the amount against current or future transfers, payouts, or amounts otherwise owed to you;
- Charging any payment method you have on file with CraftersQ, including the payment method used for your subscription;
- Invoicing you directly for any remaining balance, payable within 14 days.
Where a dispute can be contested, you must provide all supporting evidence we request (including proof of delivery or fulfilment, order records, and customer correspondence) within 3 business days of our request. Deadlines set by the card networks cannot be extended, and failure to provide evidence in time will normally result in the dispute being lost at your cost.
Our platform fee is non-refundable even if the underlying transaction is refunded or reversed. Repeated chargebacks may result in suspension of payment processing on your account.
8.4 Refunds to End Customers
Where payments are processed on CraftersQ's processor account, refunds must be issued through the CraftersQ dashboard rather than directly in your processor dashboard. Issuing a refund returns the full amount to your End Customer and recovers the corresponding amount from your connected account balance. You are responsible for setting, publishing, and honouring your own refund and cancellation policy.
8.5 No Financial Advice
CraftersQ is not a financial institution, payment processor, or money services business. We facilitate connections to third-party payment processors only.
9. Limitation of Liability
9.1 Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
9.2 Limitation
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRAFTERSQ'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO CRAFTERSQ IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) CA$100.
9.3 Exclusion of Damages
IN NO EVENT SHALL CRAFTERSQ BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO: LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITIES, GOODWILL, OR ANTICIPATED SAVINGS, REGARDLESS OF WHETHER WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
9.4 Specific Exclusions
Without limiting the above, CraftersQ is NOT liable for:
- Loss of revenue from website downtime, bugs, or service interruptions
- Inaccurate or inappropriate AI-generated content
- Losses from third-party payment processor failures or Stripe account issues
- Damages from unauthorized access to your account due to weak passwords
- Business losses from search engine ranking changes or traffic fluctuations
- Any claims by your End Customers arising from your use of the Platform
- Data breaches at third-party services you integrate with
10. Indemnification
You agree to indemnify, defend, and hold harmless CraftersQ, its officers, directors, employees, agents, and affiliates from and against all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to:
- Your use of the Platform or breach of these Terms
- User Content you create, upload, or publish
- Your violation of any law, regulation, or third-party rights
- Disputes between you and your End Customers
- Your failure to comply with applicable privacy, consumer protection, or commerce laws
- Claims that your website or content infringes intellectual property rights
- Tax liabilities, regulatory fines, or penalties arising from your business activities on the Platform
11. Termination
11.1 By You
You may close your account at any time through Settings. Paid subscriptions remain active until the end of the billing period.
11.2 By CraftersQ
We may suspend or terminate your account immediately, without notice, for:
- Violation of these Terms or Acceptable Use Policy
- Fraudulent, illegal, or harmful activity
- Non-payment after the grace period
- Extended inactivity (12+ months on free plan with no active website)
- Risk to the Platform, other users, or our reputation
11.3 Effect of Termination
Upon termination: (a) your websites will be unpublished immediately, (b) you must pay any outstanding fees, (c) sections that by nature should survive will survive (Limitation of Liability, Indemnification, IP, Governing Law, Dispute Resolution).
12. Dispute Resolution & Governing Law
12.1 Governing Law
These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles.
12.2 Informal Resolution
Before filing any formal dispute, you agree to contact us at legal@craftersq.com and attempt to resolve the dispute informally within 30 days.
12.3 Arbitration
Any dispute that cannot be resolved informally shall be settled by binding arbitration in Toronto, Ontario, under the rules of the ADR Institute of Canada. Arbitration shall be conducted in English. The arbitrator's decision shall be final and binding.
12.4 Class Action Waiver
YOU AGREE TO RESOLVE DISPUTES WITH CRAFTERSQ ON AN INDIVIDUAL BASIS ONLY. YOU WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTIONS, CLASS ARBITRATIONS, OR REPRESENTATIVE PROCEEDINGS.
12.5 Jurisdiction
For any matters not subject to arbitration, the courts of Toronto, Ontario shall have exclusive jurisdiction.
13. Service Level & Availability
We target 99.9% uptime but do not guarantee it. Scheduled maintenance will be communicated 24 hours in advance when possible. Emergency maintenance may occur without notice. We are not liable for outages caused by factors beyond our control (DDoS attacks, ISP issues, natural disasters, etc.).
14. Modifications to Terms
We may modify these Terms at any time. Material changes will be communicated via email or platform notification at least 14 days before taking effect. Your continued use after the effective date constitutes acceptance. If you disagree with changes, your sole remedy is to terminate your account.
15. General Provisions
15.1 Entire Agreement
These Terms, together with the Privacy Policy and any plan-specific terms, constitute the entire agreement between you and CraftersQ.
15.2 Severability
If any provision is found unenforceable, the remaining provisions remain in full force and effect.
15.3 No Waiver
Our failure to enforce any provision does not waive our right to enforce it later.
15.4 Assignment
You may not assign your rights under these Terms. CraftersQ may assign its rights without restriction (e.g., in case of merger or acquisition).
15.5 Force Majeure
CraftersQ is not liable for failures caused by events beyond our reasonable control, including natural disasters, war, terrorism, pandemics, government actions, internet outages, or third-party service failures.

- You agree to be legally bound by these Terms
- You are of legal age to enter into this agreement
- You accept the transaction fee structure as outlined in Section 4.3
- You agree to the dispute resolution and arbitration provisions in Section 12
